If it is, youtube just deletes it, no harm no fowl. I uploaded a video there a month ago and they deleted it due to copyright reasons...my account is not active and I did not get sued or thrown in jail.
While we don't recomend uploading copyrighted content...I think youtube is fairly 'safe'...I would just recomend putting in the description where the video is originally from and who originally did it.
